RELATING TO TOBACCO PRODUCTS REPORT.

Gives the Attorney General the ability to inspect, examine, and use the tax returns and records on file with DOTAX of any entity engaged in the business of manufacturing, wholesaling, distributing, or dealing in cigarettes or tobacco products. (Bunda, BR)

RELATING TO TOBACCO.

Designates as illegal any package of cigarettes that bears a brand name that is a registered trademark of a participating manufacturer and the package was imported by anyone other than the participating manufacturer. Establishes a criminal offense for any person to affix any cigarette stamp to the package of any cigarettes that are illegal or altered. (Bunda BR)

RELATING TO HEALTH CARE INFORMATION.

Clarifies that functions performed by law enforcement agencies, such as criminal investigations and prosecutions, are exempt from privacy of health care information requirements. (Bunda BR)

RELATING TO CHILD SUPPORT ENFORCEMENT.

Clarifies the definition of a "registering tribunal" and amends the notice requirements for proceedings to contest the validity or enforcement of a registered child support order. (Bunda BR)

RELATING TO THE UNIFORM PARENTAGE ACT.

Clarifies that a voluntary acknowledgment of paternity must also be signed by the natural mother in order for a man to be presumed to be the natural father of a child. Expands the list of persons or entities having the authority to approve a laboratory to perform the genetic testing. (Bunda BR)

RELATING TO INFORMATION ON THE NATURAL PARENTS OF THE ADOPTED MINOR CHILD.

RELATING TO HUMAN SERVICES.

Authorizes the Department to license home and community-based case management agencies. These agencies, in turn, will be responsible for certifying community care foster family homes. (Bunda BR)

RELATING TO FUNERAL ASSISTANCE PAYMENTS.

Allows the respective county medical examiner or coroner to submit an application for funeral payments under the Department's funeral payment program on behalf of an unclaimed corpse more than sixty days after the date of death of the deceased. (Bunda BR)

RELATING TO MEDICAL ASSISTANCE RECOVERY.

Expands the scope of the notice requirements to require that all parties make reasonable inquiry as to whether a claimant has received or is receiving medical assistance, and give timely written notice of any claim or action to the Department. (Bunda BR)

RELATING TO REIMBURSEMENT FOR NONINSTITUTIONAL PROVIDERS OF MEDICAL CARE FOR SERVICES.

Allows the Department to change its current method of reimbursement to noninstitutional providers of medical care from the customary methodology based on the charges of providers in a specialty to rates established by a fee schedule. (Bunda BR)

RELATING TO THE DISABILITY AND COMMUNICATION ACCESS BOARD.

Allows the Disability and Communication Access Board to assess applicant fees for sign language interpreter credentialing, and to retain the fees in a special fund to offset the cost of the credentialing/screening. (Bunda BR)

RELATING TO ENDANGERING THE WELFARE OF INCOMPETENT PERSONS.

Includes first and second degree penal sanctions against any person who intentionally or recklessly acts in a manner likely to be injurious to the physical or mental welfare of a person who is unable to care for himself because of a physical or mental disease, disorder, or defect. (Bunda BR)

RELATING TO VITAL RECORDS.

Allows for verification and certification of the existence of a birth, death, marriage, or divorce certificate and the essential facts of the vital event which are contained in the certificate in lieu of the issuance of a certified copy of the certificate. (Bunda BR)

RELATING TO VITAL STATISTICS.

Allows persons applying for certain Federal benefits to directly obtain certified copies of their former spouse's marriage or divorce certificates in support of their application. Calls for increases in the fees for certified copies of birth, marriage, divorce, and death certificates issued by DOH form $10 to $15 for the first copy issued and from $4 to $5 for each copy issued thereafter. RELATING TO THE QUEST MEDICAL ASSISTANCE PROGRAM.

Increases eligible income allowed for QUEST medical assistance program participation from 100% to 300% of the federal poverty level. Appropriates $      for FY 2001-2002 and $      for FY 2002-2003 to fund increased QUEST costs due to increases in participation. (Kanno)

Requires parity in mental health and alcohol and drug abuse treatment insurance benefits for children only; deletes QUEST exemption until July 1, 2002, from parity requirements. (Matsuura)

Allows physicians and osteopaths with two hundred hours of training in acupuncture to be licensed in acupuncture and places these practitioners under the jurisdiction of the board of medical examiners. (Matsuura)

DECISION MAKING TO FOLLOW, IF TIME PERMITS.

Persons wishing to testify should submit 30 copies of their testimony to the committee clerk, Room225, State Capitol 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.

In the interest of time, oral testimony will be limited to one minute to allow sufficient time for committee members to ask questions. Persons submitting written testimony will be recognized at the hearing and may be asked to respond to questions from committee members but will be asked not to read their testimony to the committee.
