RELATING TO ANTITRUST.

Establishes the Antitrust Trust Fund. Authorizes the deposit of 10 per cent of all antitrust judgments and settlements received by the State into the Trust Fund, and the deposit of up to $150,000 from the Attorney General's general fund appropriation to capitalize the Trust Fund.

RELATING TO THE PUBLIC UTILITIES COMMISSION.

Requires the Auditor to conduct a management audit of the public utilities commission and submit a report to the Legislature and Governor before the convening of the regular session of 2002.

RELATING TO PRESCRIPTION DRUGS.

Replaces the electronic prescription Act, Act 304, SLH 1997, which sunsets June 31, 2001, by amending the Hawaii Food, Drug, and Cosmetic Act, of chapter 328, to allow prescriptions to be electronically transmitted to pharmacies and medical oxygen distributors, and allow drug dispensers to keep records of prescriptions in electronic form.

RELATING TO PRESCRIPTION DRUGS.

Establishes the Prescription Drug Access Program to lower prescription drug costs for persons without prescription drug coverage under existing health insurance plans or government programs by pooling the purchasing power of program participants, and thereby providing the leverage needed to negotiate discounts from drug manufacturers and labelers that voluntarily participate in the program.

RELATING TO MANDATED HEALTH COVERAGE REVIEW.

Creates mandated health insurance service review panel to assess social, medical, and financial impacts of mandated health insurance coverage and recommend cap on cost of mandated health insurance coverage in terms of percentage of average annual state wage. Repeals auditor's duty to review such proposals.

Allows the Insurance Commissioner and DCCA to assess fees for issuing certificates and providing services in connection with approved insurance licensee continuing education course providers and courses.

RELATING TO ESCROW DEPOSITORIES.

Recognizes the confidentiality of portions of escrow depository company applications and records. Provides procedures to close a branch office and revises procedures to voluntarily terminate escrow depository operations. Allows the Commissioner to establish fees by rule.
