Establishes a commission to design and recommend a means of electing members of the board of education.

relating to performance-based budgeting.

Requires the DOE to fully institute a performance-based budgeting system beginning with the 2007-2009 fiscal biennium. Sets milestones for the DOE. Expands the purpose of the legislative analyst to include assisting with the evaluation of performance-based budgeting data submitted to the legislature.

Requires the Hawaii teacher standards board to develop alternative certification standards to enable military and Coast Guard personnel, veterans, reserve component personnel, and Department of Defense and Department of Energy civilian employees the board deems qualified to become teachers.

RELATING TO PUBLIC SCHOOL FACILITIES.

Exempts the acquisition of school facilities by leases from the law relating to the management of financing agreements, provided that notice of such agreements is given to the director of finance. Requires the DOE to enter into a lease agreement for a Kihei high school.

RELATING TO THE JUNIOR RESERVE OFFICERS' TRAINING CORPS.

Appropriates $40,000 to the DOE for the establishment of a Junior Reserve Officers' Training Corps (JROTC) program at Waiakea high school.

RELATING TO SCHOOL BUSES.

Requires public and private elementary school children to wear seat belts on school buses. Requires all state contracted school buses to be fitted with seat belts after 12/1/02. Appropriates funds.

RELATING TO JUVENILES.

Requires the family court to provide written notice to the district superintendent or chief administrator when a minor enrolled in a public or private school, K-12, has been adjudicated to have committed a felony. Clarifies that the court can make legal records public. Requires family court to provide reasonable access of these records to DOE. Requires the DOE to establish safeguards to protect confidentiality of this information.

Creates computerized student tracking system to track all students who are or were enrolled in the public school system in order to chart their progress from kindergarten to graduation from the UOH.

Requires funding for classroom learning materials, such as textbooks, to be considered standard workload increase items when planning and budgeting for public schools. Appropriates funds to replace lost or destroyed classroom learning materials, and to repair damaged or broken classroom learning materials.

Provides a system for monitoring textbooks by individual schools for purposes of accountability. Retains textbook replacement fees in school accounts.

DECISION MAKING TO FOLLOW, IF TIME PERMITS.

Persons wishing to testify should submit 35 copies of their testimony for the JOINT HEARING and 25 copies for the EDU ONLY to the committee clerk, Room 212, State Capitol 24 hours prior to the hearing. Testimony may also be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing. When faxing, please indicate to whom the testimony is being submitted, the date and time of the hearing, and the required number of copies needed for submittal.
