RELATING TO THE CODE OF FINANCIAL INSTITUTIONS.

Proposes provisions to address the power of the Commissioner of Financial Institutions to expedite emergency applications and to subpoena witnesses. Establishes new fee to enable the Division of Financial Institutions to recover costs incurred in responding to requests by the public to search, review, or segregate the records.

RELATING TO ESCROW DEPOSITORIES.

Recognizes the confidentiality of portions of escrow depository company applications and records. Provides procedures to close a branch office and revise procedures to voluntarily terminate escrow depository operations. And allows the Commissioner to establish new fees by rule.

RELATING TO REAL ESTATE BROKERS.

Provides for reasonable experience requirements for real estate broker candidates, streamlines regulatory requirements for condominium hotel operators, and clarifies the requirement of fidelity bond information for condominium managing agents.

Allows professional and vocational licenses of business entities to be converted when the underlying entity has been converted or merged to form a new entity.

Proposes amendments to the mortgage broker and solicitor licensing law.

RELATING TO INSURANCE.

Adds an option to the net worth requirements of mutual benefit societies and health maintenance organizations by providing another net worth component that requires a minimum net worth of three times the average of monthly net claims paid during the past calendar year be maintained by affected societies and organizations.

RELATING TO LIMITING HURRICANE PROPERTY INSURANCE RISK.

Requires risks among hurricane property insurers to be spread as much as possible so that in case of a catastrophic event, the financial health of these insurers are minimally exposed.

Gives the Hawaii Hurricane Relief Fund board of directors the power to suspend special mortgage recording fees that are imposed on all mortgages filed with the Bureau of Conveyances. Extends the authorization to issue reimbursable general obligation bonds.

RELATING TO SUBSTANCE ABUSE TREATMENT INSURANCE BENEFITS.

Eliminates substance abuse counselor certification requirements for certain licensed professionals, i.e., physicians, psychologists, advanced practice registered nurses, and clinical social workers, for health insurance reimbursement purposes.
