RELATING TO STATE WATER CODE PENALTIES.
Makes failure to maintain a natural stream channel that causes an unreasonable and substantial physical obstruction of the natural flow of water a violation of the State Water Code, with certain exceptions. Establishes a period of time after receipt of written notice of certain violations of the State Water Code during which a violator may remedy the violation or enter into a corrective action plan with the Commission on Water Resource Management (CWRM). Gives CWRM the discretion to impose a minimum penalty per State Water Code violation, increases the maximum penalty per violation, and authorizes CWRM to consider each day that a violation exists or continues to exist a separate offense. Establishes factors CWRM must consider when determining the amount of the penalty. Prohibits the State from acquiring a fee simple interest in any artificial watercourse, including a canal or ditch, under certain circumstances. Allows the State to acquire a fee simple interest in the artificial watercourse if the Legislature provides prior approval by concurrent resolution. (CD1)

Imposes a monetary penalty if an employer does not file a response within the ten-day period, unless there was good cause for the delay. Clarifies that a treatment plan is deemed accepted if an employer fails to file certain documents within the ten-day period. Establishes the Hawaii Micro-Lending Credit Enhancement Program within the Department of Business, Economic Development, and Tourism to expand micro-lending capacity by providing state‑funded loan loss reserves or other credit enhancement that absorbs first losses on qualified micro-loans made by participating lenders to Hawaii small businesses. Allows borrower fees and state matching contributions to capitalize lender-held loan loss reserve accounts. Establishes the Hawaii Micro-Lending Credit Enhancement Special Fund. RELATING TO THE MAUNA KEA STEWARDSHIP AND OVERSIGHT AUTHORITY.
Part II: Clarifies the powers of the Mauna Kea Stewardship and Oversight Authority so that it may carry out its intended duties regarding land use on Mauna Kea. Adds reversion dates of 6/30/2028 and 12/31/2029 if the deadline to adopt a management plan or to submit proposed administrative rules to the Governor is not met; extends the transition period to 12/1/2029; clarifies that the oversight and interest of MKSOA in the Mauna Kea lands shall be no more than what is expressly granted in chapter 195H, HRS; and clarifies that title to Mauna Kea lands shall remain with the State. Part III: Provides that the existing plans and administrative rules adopted or developed by UH under which Mauna Kea is currently governed remain in effect until plans and administrative rules adopted by MKSOA take effect. Part IV: Clarifies that MKSOA has state sovereign immunity. Part V: Authorizes MKSOA to extend leases and subleases before the transfer, for up to an additional ten-year term. (CD1)
