A BILL FOR AN ACT

 

 

RELATING TO AQUACULTURE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

     "§141-     Aquaculture advisory committee.  (a)  There is established an aquaculture advisory committee within the department of agriculture for administrative purposes.  The advisory committee shall provide expert and credible guidance to support and strengthen aquaculture throughout the State.

     (b)  The advisory committee shall consist of eleven members who are experienced in aquaculture, including:

     (1)  Six producing aquafarmers; provided that there shall be at least one aquafarmer from each county of the State;

     (2)  Two researchers;

     (3)  One representative from extension or investing; and

     (4)  Two representatives from the seafood distribution industry, including wholesalers, distributors, and the restaurant sector.

The members shall be appointed by the governor, as provided in section 26-34, from a list of nominees submitted by the chairperson of the board of agriculture.  The terms of advisory committee members shall be two years.

     (c)  The advisory committee shall be subject to chapter 92 and shall meet at least quarterly to review the status of the State's aquaculture industry and shall make recommendations to the chairperson of the board of agriculture on at least an annual basis.  The advisory committee may meet and subsequently make recommendations at additional times as determined by a majority of the members.

     (d)  The department of agriculture shall provide administrative support to the advisory committee.

     (e)  The members of the advisory committee shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties."

     SECTION 2.  In accordance with section 9 of article VII of the Hawaii State Constitution and sections 37-91 and 37-93, Hawaii Revised Statutes, the legislature has determined that the appropriations contained in Act 164, Regular Session of 2023, and this Act will cause the state general fund expenditure ceiling for fiscal year 2024-2025 to be exceeded by $           or      per cent.  This current declaration takes into account general fund appropriations authorized for fiscal year 2024-2025 in Act 164, Regular Session of 2023, and this Act only.  The reasons for exceeding the general fund expenditure ceiling are that:

     (1)  The appropriation made in this Act is necessary to serve the public interest; and

     (2)  The appropriation made in this Act meets the needs addressed by this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2024-2025 for the establishment of the aquaculture advisory committee.

     The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 3000.
