RELATING TO EXEMPTIONS FROM CIVIL SERVICE FOR POSITIONS IN THE DEPARTMENT OF HUMAN SERVICES.

Permanently exempts ten positions in the department of human services from civil service.  Effective 6/30/3000.  (HD1)

Status

RELATING TO WORKFORCE DEVELOPMENT.

Amends chapter 202, Hawaii Revised Statutes, to be consistent with the General Appropriations Act of 2021, Act 88, Session Laws of Hawaii 2021.  Renames "Workforce Development Council" "Hawaii Workforce Development Board" and "county workforce development board" "local workforce development board".  Requires the Hawaii Workforce Development Board and local workforce development boards to develop written conflict of interest policies consistent with federal law and regulations.  Requires the Governor to select the chairperson of the state board among the private sector members set forth in section 202-1(b)(4), Hawaii Revised Statutes.  Repeals the requirement in 371-21(d), Hawaii Revised Statutes, for the DLIR to submit an annual report to the legislature on the activities of the K-12 agriculture workforce development pipeline initiative.

RELATING TO THE WAGE AND HOUR LAW.

Expands the coverage of employees and employers covered under the minimum wage, overtime, and recordkeeping requirements of chapter 387, Hawaii Revised Statutes, by deleting from the definition of "employee" employees guaranteed a monthly compensation of $2,000 or more.

RELATING TO PROCUREMENT.

Allows agencies to rank fewer than three persons for professional services when fewer than three qualified persons respond to the solicitation or request to use alternative procurement procedures when no qualified person responds to the solicitation.

Establishes an employer child care tax credit for employers who provide or sponsor approved child care.

RELATING TO UNEMPLOYMENT INSURANCE.

Appropriates funds for unemployment insurance specialist and unemployment insurance assistant positions within the department of labor and industrial relations to prepare and support the unemployment insurance modernization project.  Appropriates funds to upgrade and modernize the unemployment insurance system.

RELATING TO THE SHORT-TIME COMPENSATION PROGRAM.

Establishes the short-time compensation program to allow employees to receive reduced compensation when employers reduce work hours in lieu of layoffs.

Clarifies that there is a presumption of a nexus for certain nonresident employees who telework.  Amends the income tax law to apply to the total income of certain nonresident employees who telework.  Applies to taxable years beginning after 12/31/2022.

Exempts small purchases of career and technical education equipment for the department of education from the electronic procurement system requirements.  Adjusts the quotation requirements for the procurement of small purchases of career and technical education equipment for the department.  Effective 7/1/3000.  (HD1)

RELATING TO TEACHERS.

Enacts the interstate teacher mobility compact to reduce the barriers to teacher license portability and employment.  Effective 6/30/3000.  (HD1)

RELATING TO FARM TO SCHOOL PROCUREMENT.

Requires the department of education to establish rules for the procurement of goods and services related to the administration of food programs at public schools that incorporate a geographic preference for unprocessed locally grown and locally raised food products.  Effective 7/1/3000.  (HD1)

RELATING TO PAID SICK LEAVE.

Requires employers to provide a minimum amount of paid sick leave to employees and supplemental paid sick leave to employees under certain public health emergency conditions.

RELATING TO COLLECTIVE BARGAINING.

Specifies that exclusive representatives of public employees are not required to provide grievance representation to collective bargaining unit members who neither pay dues nor dues equivalents and who decline to pay reasonable costs of the representation.

RELATING TO COLLECTIVE BARGAINING.

Allows telecommunications and emergency dispatchers and employees who perform similar functions employed by the State and counties to collectively bargain.

Status

RELATING TO WAGES.

Makes general contractors entering into or under contracts in the State for work on buildings, structures, or other private works liable for debt incurred by subcontractors for wages due to claimants for performance of labor in the contract between the general contractor and owner.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony received after this time will be stamped late and left to the discretion of the chair to consider.  While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may not be processed.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

The chair may institute a per-testifier time limit.

 

Committees meeting in the morning must adjourn prior to the day's Floor Session.  Therefore, due to time constraints, not all testifiers may be provided an opportunity to offer verbal comments.  However, written submissions will be considered by the committee.

 

Please refrain from profanity or uncivil behavior.  Violations may result in ejection from the hearing without the ability to rejoin.
